LMIA EXEMPT WORK PERMIT
A Labor Market Impact Assessment (LMIA) is a document that an employer in Canada may need to obtain before hiring a foreign worker. The LMIA is used to assess the impact that the hiring of a foreign worker would have on the Canadian labor market.
However, there are certain situations where a foreign worker may be exempt from the LMIA process and can obtain a work permit without the need for an LMIA. These situations are known as "LMIA-exempt."
Here are some common scenarios in which a foreign worker may be eligible for an LMIA-exempt work permit:
• Intra-company transferees: If you are an employee of a multinational company and are being transferred to a Canadian branch of the company, you may be eligible for an LMIA-exempt work permit.
• Treaty traders and investors: If you are a citizen of a country that has a free trade agreement with Canada (such as the United States or Mexico), you may be eligible for an LMIA-exempt work permit if you are coming to Canada to engage in international trade or invest in a Canadian business.
• Spouses and common-law partners of certain workers: If you are the spouse or common-law partner of a worker who is eligible for an LMIA-exempt work permit (such as an intra-company transferee or a treaty trader or investor), you may also be eligible for an LMIA-exempt work permit.
• Certain performing artists and athletes: If you are a performing artist or athlete coming to Canada to perform or compete in a specific event, you may be eligible for an LMIA-exempt work permit.
There are other situations in which a foreign worker may be eligible for an LMIA-exempt work permit.
